A federal judge just told President Trump ‘no,’ and his supporters are devastated. It is clear that an activist judge has it out for Trump and wants this case to spill over into the 2020 presidential election.
Democrats brought a lawsuit against Trump in 2017, claiming he was in violation of the Constitution’s Emoluments Clause, and Judge Emmet Sullivan has rejected an appeal from the Department of Justice (DOJ).
The DOJ asked Sullivan to allow for an appeals court to review his rulings that the lawsuit, filed by members of Congress, can go forward. Sullivan claimed that the DOJ did not make a strong enough case.
He said that “the President has failed to meet his burden of establishing ‘that an immediate appeal from the order may materially advance the ultimate termination of the litigation,'” much to the DOJ’s chagrin.
Sullivan was appointed by then-President Bill Clinton in 1994, so the possibility of partisanship being involved is high. It seems obvious that Democrats are going to do everything they can to hurt Trump.
Their lawsuit has claimed that Trump is in violation of the Emoluments Clause since his businesses continue to make money from foreign governments while he serves in the White House. The DOJ has rightly argued that Trump would have to be directly profiting for the clause to apply.
