The United States Supreme Court ruled on January 13 that it would block Joe Biden’s vaccine mandate on large private businesses through the Occupational Safety and Health Administration (OSHA), although they did allow a Centers for Medicare and Medicaid Services (CMS) mandate to stand.
The decision on the OSHA mandate was 6-3. On the CMS mandate, John Roberts and Brett Kavanaugh joined the three Democratic appointees to uphold it, 5-4.
The CMS mandate was probably allowed to stand because it is much more limited in scope, in addition to not really intruding into the private sector like the OSHA mandate obviously did.
The case was especially noteworthy from not only a political perspective, but a pop culture one.
Quotes from the judges were routinely making it into the mainstream because of how wildly off base they were, such as Justice Sonya Sotomayor’s claim that 100,000 American children were currently hospitalized because of COVID.
