Appearing on the program ‘Fox & Friends,’ the network’s senior judicial analyst, Judge Andrew Napolitano, warned against infringing upon the Constitution’s right to keep and bear arms.
Specifically, the discussion centered around what’s commonly known as ‘red flag’ laws and whether one would’ve prevented the Dayton shooter from obtaining a firearm.
According to reports, the shooter was once suspended from school for putting together a “hit list” and a “rape list,” but he was never charged with a crime.
As a result, Napolitano noted, this “reprehensible” incident didn’t show up in any database when he bought the guns. Some believe that this should not have been the case.
However, Napolitano said, “The theory of the Constitution is we don’t punish people or take their rights away from them because of what they might do, what they could do, because of what we fear they’ll do, but only because of what they have done.”
