One Supreme Court justice has had enough. It is completely over and there is no turning back. Americans are stunned by this shocking turn out events, and the political world has been upended.
Dissenting on the DACA ruling, Justice Clarence Thomas said that “the majority erroneously holds that the agency is not only permitted, but required, to continue administering unlawful programs that it inherited from a previous administration.”
Yes, the conclusion of five justices — John Roberts, Ruth Bader Ginsburg, Stephen Breyer, Sonia Sotomayor, and Elena Kagan — in Department of Homeland Security v. Regents of the University of California — was a completely illogical one.
President Donald Trump’s executive order sought to undo an unconstitutional one by former President Barack Obama, who implemented the Deferred Action for Childhood Arrivals (DACA) program without Congress passing a law.
This went far beyond the authority of the president and has been a focus of Trump’s since taking office. Unfortunately, judicial activists on the Supreme Court have now created “perverse incentives, particularly for outgoing administrations.”
