Sen. John Kennedy (R-LA) has an idea about how to know for sure whether the second impeachment of former President Donald Trump is constitutional now that he has left office.
Kennedy called during a Fox News interview Monday night for Congress to ask the Supreme Court for a ruling on the constitutionality of the upcoming Senate trial.
“I know that common sense isn’t legal in Washington, D.C.,” he said. “But I think a fair-minded rational person would ask Congress to vote to file a declaratory judgment action to ask the Supreme Court to rule on the constitutionality of impeaching a president who isn’t president before we put the country through this.”
Senate Democrats seem hell-bent on holding a trial even though 45 Republicans signaled that they didn’t think it was constitutional, which means they would vote no on the impeachment itself.
What I don’t think many people have thought about is that a trial could do a lot to bring out the absurdity of Democrats’ claims against Trump and could vindicate him of much of the animus against him.
