A liberal governor’s lockdown order was just reversed in court. Citizens are stunned by this development — and now people are wondering how the situation will play out. Legal precedent has been set.
According to the Washington Examiner, Democrat Governor J.B. Pritzker’s “30-day extension of his statewide stay-at-home order” has been overturned in what amounts to a crucial test case filed by a state lawmaker.
Rep. Darren Bailey, a member of the Illinois House of Representatives, took Pritzker’s order to court asking that the governor be prevented “from taking any action … which orders Darren Bailey to stay home.”
Circuit Court Judge Michael McHaney issued a restraining order — which only applies to Bailey — against the order, noting that Pritzker’s 30-day extension has “shredded the Constitution.”
Pritzker is reportedly claiming authority under his April 2 disaster declaration, however, Bailey contended that the law “does not explicitly outline whether such a declaration can be extended.”
It is only a matter of time before other individual citizens and groups file suit against Pritzker’s order and it all comes crashing down. Pritzker called Bailey’s action “dangerous,” but what’s so bad about protecting the Constitution?
