A major decision was just reversed by a high-ranking judge and the White House is stunned. Officials never expected this to happen, but it may be for the best. President Donald Trump’s plan can still move forward.
“An Ohio judge deemed the state’s lockdown in response to the Chinese coronavirus illegal, and stated that the state’s top health director ‘acted in an impermissibly arbitrary, unreasonable, and oppressive manner,” reported Breitbart.
In short, Ohio Department of Health Director Amy Acton has continued to declare certain businesses “non-essential” and therefore unable to open, which invited a lawsuit from approximately 35 fitness gyms in the state.
The lawsuit, which was filed by the 1851 Center for Constitutional Law on behalf of the gyms, convinced Judge Eugene Lucci and, therefore, Lucci declared that Acton’s far-reaching order was illegal and unenforceable.
Ultimately, Acton claimed authority under Ohio law that doesn’t exist. “The director has quarantined the entire people of the state of Ohio, for much more than 14 days,” wrote Lucci, noting the virus’ incubation period.
This means anyone exposed to the virus only has to quarantine for 14 days, but not any longer. Furthermore, said Lucci, “The director has no statutory authority to close all businesses.” Ohio businesses were already adhering to safety standards.
