A federal judge has ruled that former President Barack Obama violated federal statutes by unilaterally implementing the Deferred Action for Childhood Arrivals program, otherwise known as DACA.
Judge Andrew Hanen ordered the Biden administration to immediately shut down DACA in a move that will likely generate serious pushback from Democrats.
Judge Hanen wrote, “DHS violated the [Administrative Procedure Act] with the creation DACA and its continued operation … the DACA Memorandum and the DACA program that it created are hereby vacated and remanded to DHS for further consideration, as requested. DHS … is hereby enjoined from approving any new DACA applications and granting the attendant status.”
President Joe Biden was planning to add new applicants to DACA, but that plan has gone up in flames thanks to this ruling.
Former President Obama abused his executive power in establishing DACA, and it is long past time that the court system struck it down. However, this ruling won’t stop Democrats from providing amnesty to those formerly protected by DACA.
Democrats recently attempted to sneak amnesty into a Senate Democrat budget that only needed a majority vote to pass. While this might be a big win for Republicans, the fight is far from over.
