A federal judge in Florida has ruled in favor of Governor Ron DeSantis’s (R) executive order allowing parents to opt out of local mask mandates, saying that it does not violate the rights of special needs children in schools.
Twelve parents sued DeSantis and the Florida DOE over the order, saying that their children were at higher risk for death from COVID if other children came to school without masks.
Judge K. Michael Moore ruled that the parents in the suit did not use all “remedies” at their disposal before filing the lawsuit.
Surely if children were at higher risk, they could be isolated from other students or maybe even be in rooms that could be better ventilated, rather than forcing everyone to wear masks.
And the efficacy of masks is still greatly in question, so why should there be legal requirements around them?
