A federal appeals court has put a ruling on hold that would give House Democrats access to secret Mueller grand jury testimony they hope will give them ammunition for impeachment.
A D.C. Circuit Court of Appeals three-judge panel placed an administrative stay on the order, which Democrats and pundits had said should destroy the Republican argument that the impeachment inquiry is not official and that they don’t need to cooperate with it.
The stay is temporary, but will give the panel time to decide whether a longer stay is warranted as the appeal plays out. The panel included language in the ruling to make it clear that the stay should not be taken as a statement about whether a longer stay would be justified.
It isn’t certain whether the judges who granted the stay would eventually hear the appeal, but it is likely that they would based on previous actions.
Democrats claimed that the Justice Department appeal was an attempt to stall the impeachment inquiry by dragging out the proceedings.
